The passage of the Equal Access Act (1984) brought to light the legal conflict that had been building over the previous four decades over who should or should not have access to public school facilities. Following the passage of the Act, many student and community groups began to request use of school facilities. School leaders were called on to balance conflicting principles found in the Establishment Clause, the Free Exercise Clause, the Free Speech Clause, and the Equal Access Act. This study examines these issues in light of legal cases resulting from these conflicting ideals. Legal cases from 1981 through 2009 relating to the control and use of school facilities were examined. Data from the cases were analyzed to determine guiding principles to aid school administrators in making decisions that will satisfy the principles of the Equal Access while balancing the demands of the First Amendment to the United States Constitution. Free speech concerns associated with collective bargaining become important when unions impose fair-share fees that charge nonmembers for costs associated with the benefits they receive through labor negotiations. When unions collect fair-share fees, those payments often support causes with which nonmembers and dissenting members disagree. Although most people agree that unions should have the right to recoup legitimate bargaining expenses, questions arise as to what limits should be placed on the use of those fair-share fees. The U.S. Supreme Court's recent decision in "Ysura v. Pocatello Education Association" (2009) should be of interest to school business officials and other education leaders who are concerned with labor relations between teachers and their school boards. Tarrayo, Veronico N. (2018). Exploring the Coalescence of Language and Literature through a Stylistic Analysis of Cristina Pantoja Hidalgo's "When It's a Grey November in Your Soul". Journal on English Language Teaching, v8 n1 p1-17 Jan-Mar. This paper argues that in interpreting literary pieces, language and literature should team up for their mutual benefit. Based on this assumption, this study explores the interface between language and literature by examining along stylistic lines the flash fiction piece "When It's A Grey November In Your Soul" written by Cristina Pantoja Hidlago, a renowned Filipino author. Using Leech and Short's (2007) schema, the present study attempts to decipher the language code of the said literary text in terms of the following features: lexical categories, grammatical categories, figures of speech, and context and cohesion. The analysis proves that specific textual features could lend themselves well in interpreting the text. This article presents a teaching case that involves the presentation of an actual incident in which a state commission on judicial performance had to balance a judge's First Amendment rights to protected free speech against his public statements about a societal class/group that were deemed to be derogatory and inflammatory and, hence, cast suspicion on his ability to uphold the professional standards of the bench. This case can be used in courses to facilitate discussion related to public policy, discrimination, the Constitution, and ethics and professional codes of behavior.
